WAIVER/RELEASE
ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT
In consideration of being allowed to participate in any activity at the US Outdoor Championship, and to participate in any associated event, game, practice or other form of programming, under contract/agreement or by paying a one-time fee, the undersigned acknowledges, appreciates, and agrees that I HEREBY RELEASE AND HOLD HARMLESS US Outdoor Championship Organizers and Fitchburg Street Hockey League, City of Fitchburg, USA Ball Hockey Inc., MYLEC Hockey, Inc., Catalyst Street Hockey LLC and Anthony Cornacchia, Chris Orlandella and Scott Duggan, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)
This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.
READ BEFORE CONSENTING
In consideration of being allowed to participate in any way, in the 2023 US Outdoor Championship and all related events and activities, the undersigned acknowledges, appreciates, and agrees that:
1) The risk of injury from the activities involved in this tournament is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
2) I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3) I knowingly and freely assume all such risks associated with the event and accept that a medic or EMT may not be available at the rink and understand further that I willingly release the RELEASEES from any such liability for not providing same; and,
4) I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest tournament official immediately; and,
5) I recognize that a helmet is required during participation on the rink. I observe that I am playing on a hard surface which can become slick at times, therefore, I understand that head injuries can still result from slipping on the surface and other playing scenarios. I assume this risk at my own will when stepping foot on the rink. By choosing to step on the rink I relieve tournament directors from all head injuries caused during play. I also recognize that mouth guards are optional but strongly recommended by the tournament directors and the use of one helps reduce head injuries and head trauma. I recognize that I was not forced or advised to not wear a mouthguard, which was a conscious decision made by myself, and therefore assume all risk in not wearing one.
6) I recognize that any activity or crime committed on the premises the tournament is held will be prosecuted to the full extent of the law without liability to the tournament directors. By being allowed to participate in the tournament I understand that each participant agrees to the rules set out on the tournament website and made available to participants andl to team leaders which explain sportsmanship and conduct on and off the rink. Failure to follow will lead to authorities expelling you from the premises and leaving participants with sole responsibility and liability in the matter.
7) I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS the US Outdoor Championship Organizers and Fitchburg Street Hockey League, City of Fitchburg, USA Ball Hockey Inc., MYLEC Hockey, Inc., Catalyst Street Hockey LLC and Anthony Cornacchia, Chris Orlandella and Scott Duggan, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
I hereby understand and accept that the Catalyst Street Hockey LLC fees are non-refundable, no matter the reason requested.
